Legal Question in Family Law in Minnesota

What factors are considered in determining child support payments?

My girlfriend and I have split. Under MN support guidelines, it appears I fall right into the beginning range of 25% of your net pay for child support. If I'm to pay for apartment rent, car payment/insurance and child support under these guidelines, it would leave me with about $20 a month for food, utilities, gasoline...etc. I'm hearing alot of conflicting advice. My question is...in determining the amount of support to be paid every month, will my housing costs and other debts be considered, or will I have to live out in the street in order to pay this required 25%? Thank You!

Re: What factors are considered in determining child support payments?

The child support guidelines a presumption of what child support should be paid. Absent a compelling reason to deviate from those guidelines, the Court will set child support based on them.

The Court may consider your expenses. However, if they are not extraordinary in some regard, they will not result in a downward deviation from guideline support.
