Legal Question in Family Law in Minnesota

Father wants child from Grandparents

What has to be done if: the mother left the child with her parents in MN. and left to another state, while the father was in Fl. The mother has not been involved with the child for a few months. The father wants the child and is wondering if there are any legal actions that must be taken in order to get the child? No one actually has custody of the child. Can he just go get the child?

If paternity has not been determined or recognized as part of a Court order, you do not have any rights to take custody.

If you signed a Recognition of Parentage at teh hospital when the child was born, you may bring an action to confirm paternity and seek custody. To bring such an action, you must serve the mother.
