Legal Question in Family Law in Minnesota
My father watches my nephew during the week while my brother is out for the week truck driving. My father served my brother papers for custody of my nephew and refuses to give my nephew back to my brother. How does my brother get his son back since my father is refusing to give him back?

It is difficult to give you an answer on the few facts you have provided, there seems to be some important facts left out. If your brother has custodial rights there should be nothing prohibiting him from just going and picking up his son. If there are court orders to the contrary they should be followed. Your brother should properly respond to any petitions or proceedings that would effect his parental rights.
