Force to Move Out

How do I get my soon to be ex to move out? Do I have to get a court order? We have a 2nd house that he can move to.

As part of any divorce, you can file a Motion seeking temporary relief. That would include asking for sole occupancy of the residency, dividing marital debt uuntil the divorce is final and determining custody and parenting schedules until those issues can be resolved. How you proceed in such a motion can set the tone for your entire divorce proceding. As a result, it is wise to be agressive initially.

Unless you can get him to agree to move out, you will need a court order. Most often, after a divorce case has been started, an initial hearing is scheduled. At that time you can request that be required to move out. Please contact me if you want to set up a free initial consultation.
