We went to a local attorney for a free consultation about a will. He said he would send us a sample will to review. No hiring contract was signed at that time. Now he summond us to pay $1250 Dollars, and claims a verbal contract is legal. We did not hire him at the time. We understood that this was a free consultation and only if we like his sample of will, we than would contract his firm, which did not happen. Is this legal for him to ask for payment without a written and signed contract? He claims a verbal contract is binding and would hold up in court.

A verbal contract may be valid and binding, but there must be an agreement. If there is no agreement, there is no contract.
