Legal Question in Family Law in Minnesota
Grandparents
How can ex mother-in-law file a motion for Grandparents rights/visitations, on my daughter's divorce case? She also tried to beat my daughter up when she was 8 months pregnant while the children watched in horror.X son-in-law is out of the country.National Guards. X's family has had no contact what so ever with my Grandchildren since August 2004. Before that only sometimes once a month visits when ex son-in-law took the children there for visits.X is also pending child abuse charges when he returns to the States. New wife has been abusing my Grandchildren as well. Not to be alone with them. I find this to be outrages for her to file on the divorce case. She should have to file her own. What rights does she have? How can she intervene in the other case?

Re: Grandparents
Minnesota law allows a grandparent to petition for visitation rights in a divorce proceeding, but it cannot be awarded if the court finds that it would interfere with the parent-child relationship, or is not in the child's best interests.
Re: Grandparents
Minnesota Statues provide for Grandparents visitation. It is allowed if based on the best interests of the children. No separate Motion is necessary
518.1752 Grandparent visitation.

after the commencement of the proceeding or at any time after completion of the proceedings, and continuing during the minority of the child, the court may make an order granting visitation rights to grandparents under section 257C.08,
