Legal Question in Family Law in Minnesota

Have not heard from Expeditor in 4 weeks!

In February myself and my child's mother met with our court apointed parenting time expeditor to work out a new parenting time schedule because my ex was moving our 9 year old from MN to hudson, WI. We disagreed and the expeditor said she would weigh our arguments and make a decision; that was FOUR weeks ago. I have left her mutiple phone messages, emails--no reply. Isn't there a 5 day turn around law? Now my child is set to move in 2 weeks and I have no power to stop them b/c our expeditor said she'd have at the very least a new order in place. What should I do? Should I just give the expeditor more time? Both parties paid her full retainer already. Please help--time is running out.

Thanks.

The real onus here is on the other parent. That parent, under law, is not allowed to relocate with the child unless there is an agreement of the parties or an Order from the court. In other words, no decision by the PTE means that she cannot relocate.

If time is drawing near for the proposed relocation, you must be oprepared to file a Motion precluding the relocation from occurring and/or, in the event of a decision that you do not agree with by the PTE, you should be prepared to file a Motion to Stay the expeditor's decision pending a court hearing.
