Legal Question in Family Law in Minnesota
Hmong Marriages Recognition in MN
The Hmong people has been welcomed and embrassed in Minnesota for a few decades now. Its cultures and ways have been largely respected. The Hmongs conduct roughly 90% of their marriages within their community, without seeking the marriage license document that legalizes the union in the state of Minnesota. Are Hmong marriages lacking a marriage license considered legal in Minnesota? Would the dissolution of the union be seen in family court or other courts as separate assets are being divided?

Re: Hmong Marriages Recognition in MN
A marriage that is valid an any other country would be granted full faith and credit here so log as it did not violate the laws rendering i=t a null marriage.
However, a marriage that is condicted here, that does not follow legal protocol under the state laws, would not be binding and offers no protection of the law.
Re: Hmong Marriages Recognition in MN
If they are married in another country and then come to Minnesota, the courts here would probably consider them married. However, if they got married in Minnesota, and failed to get a license and follow proper procedures, the court may not recognize that the parties were legally married. As a result, normal protections for a spouse under divorce law may not apply.
