Legal Question in Family Law in Minnesota
My husband is abusive and I'm afraid of what he will do if I file for divorce. I want him served when I'm far away. My family lives in NC and I want to go back. Can I take my son and have him served afterwards? Can I get time to gather my stuff while he's away from the house? My daughters are afraid of him, he beats his daughter, and his ex wife filed a domestic abuse case on him.

You are free to move prior to commencing your divorce and it is much easier for you to do that before you have your husband served. If you move to NC, I suggest that you hire an attorney from Minnesota to take care of your divorce. Also, keep track of the abuse that happens and write down the abuse that happened in the past because all that information might become relevant during the divorce.
