Legal Question in Family Law in Minnesota

My husband and his ex are each to pay 50% of what insurance does not pay for their daughters medical and dental bills. When his ex said she wanted to get braces for thier daughter, my husband told her that he could not afford it. She went ahead and got the braces put on and is now threatening to sue us for over $3000. Are we legally responsible since this is an elective dental treatment and we refused in the beginning?

It depends on what your husband's Judgment and Decree states. If according to the Judgment and Decree your husband is responsible for one half of the orthodontia expenses and he does not pay, his ex can attempt to collect from him. Minn. Stat. 518A.41, subds. 17 & 18 explain how this can be done. Here is a link to that statute: https://www.revisor.mn.gov/statutes/?id=518A.41&year=2010&keyword_type=all&keyword=unreimbursed+medical.
