Legal Question in Family Law in Minnesota

My ex husband is not paying support and has not attempted to contact my 3 daughters in over 4 years, they don't even know who he is. I am now with someone else and he is wanting to adopt them when we get married. How hard is it to go about this? Should I attempt to revoke his legal rights prior to getting married?

You may file a Petition to terminate Parental Right. the simplest way to proceed is to have the other parent agree to terminate parental rights, At that point you may proceed with a step parent adoption.

You may also seek to terminate parental rights in a contested proceeding. However, you must serve the other parent with the action. If you cannotlocate that person, you must seek permission of the court to serve by laternative service, usually publication. In such an important matter, the court will often require personal service.
