Legal Question in Family Law in Minnesota

My ex husband physically assulted me.

My children and I were recently granted a 1 year restraining order against my ex-husband (this is the second one in 1-1/2 years). When he would see our children, he would tell them sick stories (things like, my sisters & I had group sex with my father, etc). The last time he saw the children, he assulted me & scared the children so much that they tried to jump out of his car. Also, I have been documenting his sick behavior since 10-15-05 & have copies of voice mails, conversations, etc. The ages of our children are 7 & 9. How do I get the visitation schedule in my divorce decree modified from e/o weekend to supervised visitation? Is this possible? Do I go thru mediation as outlined in my divorce decree? Or does the restraining order effect that? I have full physical and joint legal custody. Thanks for your advice.

Re: My ex husband physically assulted me.

Tthank you for the post.

Visitation schedules may be modified based on a "best interest of the child" standard. As a result, you must file your motion in family court and support that motion with affidvaits and documentary evidence such as police reports, medical reports or psychological records setting out the impact that his behavior has had upon the children.

We can certainly assist you in that regard. For a consultation call us or visit divorceprofessionals.com
