Legal Question in Family Law in Minnesota
Ex husband says he can stop me from moving within state....
My ex husband and I have joint legal but I have sole physical custody of our three children. I suggested to him that we might have to move into my in-laws house and he said that he would never allow it because the kids didn't like it there. There is no drug use, no alcohol abuse, nothing illegal going on. He stated to me that if he didn't like where I was going to move, to my in-laws or up north that he could bring me to court and get custody. I was told that I could move anywhere in the state without his permission, as long as it was within the state. Can he really take the kids if he doesn't like the city or area I live in?

Re: Ex husband says he can stop me from moving within state....
You are correct. A relocation with the minor children within the state does not require consent of the other party or an Order of the Court. Unless your former spouse can demonstrate that the move "endangers" the children, he will not have any chance seeking a change of custody.
