Legal Question in Family Law in Minnesota
My husbands ex wife is denying us visits with his 2 kids. She keeps saying not this weekend we are busy. When my husband calls to talk to his children she wont answer. If she does answer she claims the kids dont want to talk. She argues with him about everything and then hangs up. When he calls back to talk to kids she tells him to stop calling. His daughter is 10 and refuses to talk to him and if she does talk to him she acts like shes scared. What can we do to visit the kids and talk to them without going to court. it states in divorce papers that he gets to get the kids everyother weekendp.

You need to first review your divorce decree to see whether you need to attempt mediation or use the services of a Parenting Consultant before you ask the Court to help you with this parenting time issue. If you do not need to attempt mediation or use the services of a parenting professional, then you can bring a motion to request that the Court help you. Check out the website of MNCourts.gov. On the right side of that website, click on Court Forms and then find the category dealing with parenting time. There are forms to request that the Court assist you with the parenting time issue. You may also want to consult with a family law attorney. There are many attorneys that do not charge for a free consultation.
