Is an inheiritance during the marriage considered community property under Minnesota law for divorce and division of property rights?

Generally inheritances are considered non-marital property and are not subject to division with the spouse in a divorce. If the property has been commingled with marital assets, however, they could be divided.

The answer depends on what was inherited and how that inheritance was treated during the marriage. As a general rule, any inheritance falls into a category of non-marital property , but that designation can be lost if co-mingled with marotal assets or if marital money is spend to maintain the asset.
