judgement and decree
I am the petitioner in a judgement and decree signed Dec. 18,2008.
The decree states: Respondent is awarded all right,title,and interest in the 2002 Kia Sportage subject to any encumbrances thereon, but free and clear of any claim by the petitioner.The respondent shall have 60 days from the date of the final decree to refinance the 2002 Kia Sportge into her name and transfer the title. The title and loan are in my name. I have possesion of the title and loan documents, along with key to vehicle. Do I have legal right to retake the vehicle?

I am afraid that your divorce decree is very clear on the issue. The vehicle is awarded to the respondent and you have no claim on that vehicle. If there was no additional language on the decree that allowed you ownership of the vehicle if certain conditions were not met, like refinancing, your only remedy is a Motion for contempt.
