Legal Question in Family Law in Minnesota

I want to leave the state with my 1 yr old son. His father has had nothing to do with us at all and in fact threw me on the streets when I was 6mths pregnant! Now he suddenly pops up with his brand new wife and wants to have custody. I want my son to have nothing to do with this man(boy) for many reasons. Can I go or will they end up taking my son?

If you were married when the child was born or if the father hass commenced a custody acrtion or been granted parenting time, you may not relocate out of state without his consent or a court order.
