Legal guardianship

My sister could not take care of her 5 year old child so my brother & his wife took legal custody. I believe it started as foster care where they received help from the state to take care of her. He doesn't receive any benefits for her now though. He is being sent to Iraq next week and his wife cannot take her with her. I am afraid the state will put her in foster care. Is there someway I can take care of her with the state's approval? Like a temporary foster care until my brother returns, he'll take her back then. However, I also have 2 children that are older, but I support most of their care. Is there some benefits she can receive while in my care?

This is a complicated situation that requires a personal visit with an attorney. I practice in Mankato. I can't tell from your zip code exactly where you reside.
