Legal Question in Family Law in Minnesota

legally binding agreement

I live in MN. If I signed an agreement along with my boyfriend, 2 witnesses and have it notorized stating he would get full physical custody if I hit him again, would that stand in court if such events did occur?

Agreements with respect to custody are not enforceable unless adopted by a court as part of a court order. Your agreement would have almost no impact on a custody determination since courts must determine custody matters based on statutory criteria relating to what is in the children's best interest.

However, as part of any custody case a court will certainly consider whether either party is abusive. Your "contract" couold be used as evidence that you resort to physical violence to resolve your issues.
