Legal Question in Family Law in Minnesota

I live in Minnesota and my daughters father is signing over his rights to her. She has his last name and I would like to change it to mine. The thing is I am married. So could I change it to my married name without my husband having to adopt her.

I am not exactly sure what you mean by he is "signing over his rights to her," but you can change her name to whatever you like if you follow the proper procedures. You husband does not have to adopt her to use his name. Most likely, however, you will have file an application with the court and get a court order.
