Under Minnesota law, custody can be modified by a court if there is a consistent and willful denial of parental rights by one party. That means you must have acourt ordered parenting schedule and not just an "agreement" regarding contact. It also generally would require more than a one time event and, in most cases would have to be supported by one or more Motions for contempt to compel compliance with the court order first.
