Legal Question in Family Law in Minnesota

Mental Health of Spouse

My wife has some very serious mental health issues, she has threatened to commit suicide, threatened me with a knife, and in general is just miserable and out of control every day. However she refuses to seek medical help. Can I force her to get help?

Re: Mental Health of Spouse

This is a very difficult issue. Whether you can compel her to get medical attention depends primarily upon whether she poses a threat to herself or others, or is legally incompetent (generally, incapable of managing her own personal affairs).

I would need more facts to provide you with meaningful advice about this matter. The issues you are dealing with can be extremely delicate, and require a careful analysis. If not handled properly, a committment proceeding (if that is indeed reasonable) can create more trouble than you have to start with. Short of that, I can suggest (and would in fact encourage) several less intrusive means of intervention. But again, many more facts are required for a proper evaluation.
