Legal Question in Family Law in Minnesota

The Right To Move

I have 3 children I share legal/physical custody with their father. I'm engaged and will be moving about 25 minutes away. Can their father stop me from moving the children? They spend about 70% of the time with me.

Re: The Right To Move

If you share physical custody and the relocation will affect the parenting schedule, it is possible that eiither party may seek a change of physical custody. Whether the change occurs will depend on many things including the ease with which parenting time may be arranged.

It depends on where you are moving, how it will affect his time with the children (given the longer driving times) and, most importantly, how it will affect the children's schooling. Please contact me if you have any other questions.
