moving my child to another state

I have recently received a job offer in another state. The father of my daughter has agreed to this move. We do have a custody order filed in Dakota County that allows him visitation (which he does not exercise), does this mean we have to file a consent to move as well or appear in court? What steps do I need to take to make sure this is done properly?

Since you have the consent of the child's father to move, this makes things simple. Minnesota Statute 518.175, Subd. 3, allows a custodial parent to move to another state if the court allows it by order OR if the noncustodial parent gives his/her consent. If you are worried about the noncustodial parent going back on his word, you should ask him to sign a simple statement in front of a notary that indicates his consent to your move. Then keep the original signed statement in case you ever need it to prove his consent. Otherwise, you need do nothing else, since you have already obtained his consent.
