Legal Question in Family Law in Minnesota

Moving to another state with children

I currently reside in Minnepolis, MN with my two children, their father lives here also and has visitation rights. I have been offered a position in Alabama which will improve my employment and put me close to my family who can provide me better family support than I am now able to receive. My X will not give me permission to move the children. Is there a form for filing a petition to get a court order so I can take the position?

Re: Moving to another state with children

Under Minnesota law, in oprder to relocate to another state with minor children, a parent must have permission of teh other party or an order of the court to allow teh relocation.

There are no forms to seek that relocation,. Moreover, if not properly filed, the motion may be denied if the court believes that it will interfere with the other parent's relationship with the children and it was intended for that purpose. As a result, a thorough and complete motion with supporting affidavits must be filed.
