Moving States
I am planning on moving states this summer. I have a 8 year old daughter that I am bringing with. I have already made the court date for Parenting Time change which was April 25th, the father of my daughter called the day before at 3:30 to the judge stating that he can not make it because the state took his drivers license away and claims he just got my Notice of Motion and Motion which I sent out March 18th.
I showed up to court only to have the judge tell me to come back on the 30th of June because of the fathers claim and his no license.
He has not seen his daughter since January 2008, He doesn't pay his child support (thus why his License revoked), he never calls her back when she does call, cancels his weekends and has no idea what is going on in her life.
My question is:
I am making this move to better my daughters life and also mine.
How can I make sure he gets the new papers and he doesn't lie again?
What can I say on the paperwork that would be a fair visiting schedule for her although he really doesn't do anything for her.
He is one of those types that could care less about his daughter but once I want to change something in the order he trys to fight me.
Should I seek a lawyer on this?

Papers should be served by personal service and the messanger who delivers them provides you with an affidavit of service to file with the court. You would be wise to seek a lawyer. Changes in the law make it far more difficult for a parent to relocate out of state with a minor child.
