Legal Question in Family Law in Minnesota

I am looking at moving out of town currently to about 2 hours away still within state. My ex currently has every other weekend and one day a week. However due to his job he has them random times approx 8-11 days a month and I allow this. Both kids will be in school next year. Do I need to go to court for this. He states he will never allow me to leave.

If the parenting time will change, you must modify the parenting time. There is nothing that requiers you to seek cour permission to relocate within the state.

You are required to go to court and seek permission for a move only if you are moving out of state. If the existing parenting schedule will change, it is perhaps likely he will bring a motion seeking a change in the schedule, or may ask that you be required to take on a greater share of the responsibility for travel. You may be wise to approach him before you move to discuss the issue, although that depends on the dynamics of your relationship with him, the nature of the existing schedule (whether it is included in a court order), and other factors. If you have additional questions, feel free to call.

Good luck.
