Would a non biological grandparent still be able to fight for custody if their spouse which was the biological grandparent is now deceased?

The third party custody laws n Minnesota would bnot preclude a non-biological grandparent from seeking custody. However, the law prefers parents and, it would take some compelling evidence to prevail.
