Notarization Question

boyfriend and I broke up we filled out joint custody papers which was not notarized or signed in front of a witness or judge

he moved to a different state and had his copies notarized with out me present is that declared a felony?

The penalty depends on what state this occurred in. I would need more information on the state so I could direct you to a statute.
