Order to Show Cause

We had a court date with my Husbands Ex wife today, we were attempting to hold her in contempt of court for disregarding what the Divorce decree says & lying to the Judge at our court date last year, We also had a motion filed to suspend or revoke her Visitation upon a court ordered psych evaluation & counseling.

We had over 3000 pages of evidence agenst her, however the Judge said we did it wrong, we needed an ''Order to show Cause'' & something about the county attorney possibly reviewing the motion. We did not understand what the Order to show cause is, I cannot find a definition or anything under the state statute website, would you be able to shed some light on this for us?

Any motion for contempt must be accompanied by an Order to Show Cause.

An order to show cause is simply an Order requiring the person who is in contempt to appear. That Order is presented to a signing Judge along with your motion and affidavit. If the Court determines that contempt of Court has been alleged in the papers, it will sign the Order to show cause. The Order to show cause is served along with a copy of the affidavit and Motion on the party. The orginals are filed with the state.
