Legal Question in Family Law in Minnesota

parental rights

I am trying to find out if it is possible to terminate my daughter's fathers parenting rights

I have full custody of my daughter. We both have OFP's against him for abuse. Child protection services has investigated and found neglect and endagerment against him. He pled guilty to gross misdemeanor OFP violation and misdemeanor disorderly conduct against my daughter (sentencing in Aug) He is $2800 behind in child support. He is ordered to attend suppervised parenting time to see her, which he use to attend on and off but now has not attended in 2 months. He was also ordered a year ago to attend parenting classes and anger management, which he has not yet started.

To me and many others he is your classic dead beat dad. We were never married. He did have split legal custody with me for like 4-5 months but the courts took it away after the whole OFP stuff. This has been an ongoing battle for 2 years and I don't want my daughter to have to deal with it anymore.

She never wants to see him and states she is scared of him.

What are my options? Is it a strong enough case to get his parental right terminated? If so where do I start?

Thank you for your time

ann

Re: parental rights

It certainly looks like you have sufficient grounds according to the statute. However, he can deny and require you to provide clear and convincing evidence of the neglect in an evidentiary hearing. That could be somewhat expensive but it would appear to be a good decision. Dennis.
