power of attoney

my mother passed away in oct.2005, my brother had the power of attoney , what is his legel responibly to divide my mothers estate between myself and two other brothers?

A Power of Attorney grants rights to a person over another person't financial matters during their lifetime. When that person dies, the powers under the Power of Attorney die as well.

Any relative may file in probate court to be the personal representative of the estate. If there is no Will, the assets are distributed according to statute.
