Legal Question in Family Law in Minnesota

what are my property rights?

I have been in a dire situation for nearly 8 years, as the man I have been with moved into my home, and has refused to leave it. He has junk vehicles on my property he refuses to move, and I am afraid he will also take with him my dog, and furniture he has given me as gifts, I own the property exclusively, what rights have I got if I kick him out for abusive behaviour towards me over all these years?

Re: what are my property rights?

Thank you for your question.

If you are experiencing abusive behavior and are reasonably in fear that he will cause you physical harm, you can petition the court for a domestic abuse restraining order.

If he is removed under a domestic abuse order, he will prevented from coming to your home, and will be prevented from removing property without your permission, or the permission of the court.

This is not a permanent sollution, but it may help to stabilize the situation until other issues (ownership of property, etc.) can be resolved.

If that is not a possibility, and you own the home, you have the authority to exclude him from the property, regardless of his previous residence in your home. You could, at least in theory, simply lock him out of the home. If you have any concern that this would precipitate a violent response, I would not do so, and would consider, instead, an order for protection.

It is difficult to provide anything more than cursory advice in this context, since there are many facts that would have to be evaluated to give you a proper answer. If you have further questions, my contact information is below.

Good luck.
