this is a question i would like answered free. if im getting a divorce , does the spouse get half of the 401 k? an if so what persentage does the spouse get penalize for taking it out?

Yes. The 401K can be divided into an account in the spouse's name by a Qualified Domestic relations Order where no penalties would apply.
