Relocating out of state

My husband may have a chance in the next couple of years to relocate with his current employer to Colorado. I have full physical custody of my son and was wondering what I would have to do in order to leave the state and bring my son with. My ex-husband also lives in Minnesota and I know he would not be happy if I moved. I need advise on what it takes to relocate without put my son through alot of turmoil. Thanks.

You will need to make a formal Motion before the Court to ask permission to leave and relocate your son to another state. Please feel free to call me. In order to relocate out of state with you minor child you must have permission of the other parent or an order of the Court. In short, if your ex will not agree, you must file a motion.

In any such motion, there is a poresumption that the minor child should remain in the care of teh parent with physical custody. However, you must not take this for granted and should prpare your case carefully.
