Signing Away Parental Rights
My son will be 6 in Mar. His biological dad has had nothing to do with him and owes support. I am getting married in Dec. and my fiance wants to adopt him. What would we need to do to have his biological father sign his rights away so we could proceed? My fiance is the only dad my son has ever known.

I have represented couples in step-parent adoptions and could certainly help you. If we can convince the biological father to consent to the adpotion, the case will be able to proceed without much difficulty. If he won't consent, then we would need to take the biological father to court to request that his parental rights be terminated. This is a much more difficult procedure. You would need the biological father to sign a consent form or you would have to terminate his rights. That would be an additional proceeding to the adoption. Dennis
