Legal Question in Family Law in Minnesota

Son and daughter-in-law won't let us (grandparents) have communication or see ou

Our son and daughter-in-law have now restricted our ability to see and talk with our granddaughter. This arose out of an argument of safety. They feel that since we allowed her (she is 3 years old and does this with her father in St Paul) to sit on my lap and turn the wheel of a car while in the drive way, we were endangering her life. They are also very anal about some foods and were dismayed when we took her to the Zoo and gave her a hot dog.

Is the a court case that we can read and that would set precedent that we should legally be allowed to see and have our granddaughter visit our home without her parents HOVERING over us?

FIRST, please read A.R.S. 25-409. Visitation rights of grandparents and great-grandparents

A. The superior court may grant the grandparents of the child reasonable visitation rights to the child during the child's minority on a finding that the visitation rights would be in the best interests of the child and any of the following is true:

1. The marriage of the parents of the child has been dissolved for at least three months.

2. A parent of the child has been deceased or has been missing for at least three months. For the purposes of this paragraph, a parent is considered to be missing if the parent's location has not been determined and the parent has been reported as missing to a law enforcement agency.

3. The child was born out of wedlock.

B. The superior court may grant the great-grandparents of the child reasonable visitation rights on a finding that the great-grandparents would be entitled to such rights under subsection A if the great-grandparents were grandparents of the child.

Grandparent visitation is allowed by the court only under certain circumstances. Every case is different and I would need to know more details before I could answer whether you have rights to such visitation with your grandchild. Please feel free to contact me at 952-746-4111 if you want to discuss your specific situation.
