Legal Question in Family Law in Minnesota
My son is currently incarcerated until November of this year. He has a 15 year old son who is having some troubles and the mother is not keeping us informed. My son and the mother have shared legal custody, mother has sole physical. If my son signs a Power of Attorney naming me as his POA, would that allow me to speak to my grandsons case worker, therapist etc... in place of my son? Can it be a standard POA or does it have to be a specific Delegation of Parental rights POA?

Hello. If I were to assist you, I would want to discuss full details with you prior to advising you as to best option or options. I suggest you pay a very well experienced attorney to provide you with legal counsel at this time. Be wary of 'free advice'. We attorneys here do not solicit clients. Be aware that a very small subset of us attorneys are particularly knowledgeable and experienced as to family law and criminal law matters, and have special knowledge training and experience as to incarcerated persons, and 'teens in trouble' (often quite complicated issues, often chem' use involved, mental health troubles...etc., etc., etc.)
So sorry your son and his son both face troubles. Being a teen boy is so very difficult.
As to your son who's incarcerated, you seem to be a loving, very caring 'mom', and that is so wonderful. So many people who have trouble with the law are all alone, abandoned. Best to all of you.
