Legal Question in Family Law in Minnesota

My son's father texted me and said he has better things to do then take his son on his court ordered day. Tomorrow is his schedualed day and also his son's birthday and he had that court ordered that he have 1/2 a day with him, but now is telling me he has better things to do then be with his son. is this fair and healthy for the 1 year old child? Is this legal and what should i do about. i feel he is unstable and isn't fit to take care of him. He has had an excuse for the last 3 1/2 weeks as to why he can't take his son on his court ordered parenting time.

Unfortunately, you cannot force a parent to exercise their parenting time. That does not, however, make them unstanble or unable to care for the child. If he does not exercise his parenting time, you may file a Motion to modify that parenting time to a schedule that reflects how often he actually sees the child.
