Spousal Maintenance and MTA
I am a Male involved in dissolutionment of marraige after 20 yrs. Spouse initiated the process. Trying to end with a MTA but appears to contain ridiculous demands. Total take home is approx. 2900\mo. Monthly expenses total approx. 2300\mo. (this includes 865\mo in child support). She is requesting the following:
1. 1,000\mo spousal maintenance (was born with hearing issues and has had numerous ear surgeries. Wears hearing aides. Claims due to handicap, she is unable to obtain higher paying job).
2. Wants reimbursement for child monthly medical insurance payments. Insurance premiums are payroll deducted.
3. I am willing to give her quick claim deed but she requests the following:
a. I pay for half of improvements (painting, carpet, etc.)
b. I cannot recoup any upgrades at time of sale of home.
4. Pay 50% of any out-of-pocket expenses for child (i.e. Tutor, etc.)
I also suffer from a handicap, (type 1 diabetes), but do not let it intefere. I also suffer from carpal tunel syndrome that will require surgery on both wrists. I work in the IT field. Her lack of earning power is due to lack of motivation.
Since I am unable to meet her financial requests, how can I save what little I have?

As part of the divorce process, discovery is necessary to determine the income, earning capacity and expenses of each party. Often an agressive posture at the beginning of the divorce is necessary to get more reasonable concessions.
