Spousal support info

My husband and I are initiating a mediated divorce. We are in agreement on all issues except spousal maintenance. I want a general ''baseline'' of appropriate spousal support for negotiating purposes--i.e. duration, amount, restrictions. We have been married for 20 years. I have been at home with the children the entire time, working seasonal part time jobs for Christmas etc.I am 45 years old & have struggled with a painful, potentially very debilitating genetic disease for many years. I also have long standing clinical depression. My husband is an upper level executive with a salary in the mid 100 k range. We have no debt except mortgage, and have had a high standard of living for many years. I will need additional education for work after the divorce. My career area has an average starting salary of $15,000 which approaches $23,000 after 15 years. I am not sure if I will be able to consistently work full time because of my health. Our children are adults.

Unfortunately, it is possible to provide you with a ballpark number based n the limited facts provided. It would require a complete review of all the financial circumstances and other factors. Certainly, on its face, it appears that this is a case where a presumption for permanent spousal support is appropriate.

You must understand that unlike child support statutes, there are no percentage guidelines to determine when spousal maintenance or alimony is appropriate or at what level. As a result, trial courts have broad discretion in deciding whether to award maintenance and in determining its duration and amount. It is for this very reason that spousal maintenance often becomes one of the most contested issues in divorce proceedings.

Currently, spousal maintenance awards are generally granted if the spouse seeking maintenance demonstrates that he or she:

(1)lacks sufficient property, including marital property apportioned as part of the divorce to provide for the reasonable needs of the spouse considering the standard of living established during the marriage, especially, but not limited to, a period of training or education; or

(2)is unable to provide adequate self-support, after considering the standard of living established during the marriage and all relevant circumstance, through appropriate employment, or

(3) is the custodian of a child whose condition and circumstances make it appropriate that the custodian not be required to seek employment outside the home.

In determining the amount and duration of spousal maintenance, state statutes require that Courts address all relevant factors. Most statutes also specifically identify specific issues that should be considered in determining awards of spousal maintenance:

(1)The financial resources of the spouse seeking maintenance;

(2)The amount of time that is necessary for the spouse seeking maintenance to acquire necessary skills or education to find appropriate employment;

(3)The age and physical and emotional health of the recipient spouse;

(4)The standard of living established during the marriage;

(5)The length of the marriage;

(6)The contribution and economic sacrifices of a homemaker including loss of seniority, retirement benefits and other employment opportunities foregone while working at home

(7)The financial resources available to the spouse from whom maintenance is sought.
