Statutory rape laws?

I have a friend that is 17 and pregnant by a man age 37. They are not married but live together. The question is she will need medical assistance to have this child as they have no medical insurance, she is worried they will go after the father for statutory rape issues. Can they? I am referring to the staff at the hospital or social services. Thanks

The age of consent is 16 so long as the older person is not in a position of authority (teacher, priest etc...)
