Legal Question in Family Law in Minnesota

step-parent adoption

I have an 8 y.o. and the biological father has never seen her. My husband would like to adopt my child, but I understand that parental rights need to be terminated. How do I go about making this happen? What is the first step?

Re: step-parent adoption

The first advisable step would be to contact the father and seek an agreement. Once you have an agreement, the process is relatively simple and you may proceed with a Termination of Parental Rights and Step-Parent Adoption.

If you cannot garner an agreement, you would serve and file a petiotoin to terminate parental rights based on abandonmentg or other statutory reasons. If contested, that can be a fairly lengthy process. However, you appear to have a strong basis on which to proceed.
