Tax claiming of children ?

We have a divorce decree saying I pay child support and have the rights to claim the children. The ex filed and claimed them anyways and says ''I has rights'', well when they asked the judge for the right (again in 2008) he said NO. Now the ex has already filed & claimed them anyways saying she talked to IRS and they said she can. My tax prepared says we also should claim and send in the legal divorce decree saying I have the rights. What do I do?

Take your tax preparer's advice, you have a divorce judgment that says you get to claim the kids, your ex is likely going to lose out on this one.
