Legal Question in Family Law in Minnesota
Over ten years ago, I was in prison and the minnesota courts appointed me the father of a child; I have never met this child and am being told I have to pay thousands of dollars if I don't want to go to jail. I have doubts that I am actually the biological father, but the courts say it's too late for a DNA test and that they are within their right. Even if they are within THEIR rights, wouldn't be within MY rights to know whether or not I am the father? And if I turn out not to be, shouldn't they be forced to leave me alone?

Hello. I urge you to have a private attorney assist you at this time. It may be possible for actions to be taken that may resolve this situation more favorably to you. More details of the facts need to be known in order to advise you appropriately. You mentioned prior court action pertaining to DNA testing, so that would need to be addressed. Some attorneys, myself included, are available seven days for emergency legal needs. Many attorneys will confer initially at no charge. Then, if legal work is performed, some attorneys, myself included, will provide a reduced fee for financial hardship. All the best.
Whether you may file an action to disclaim paternity would depend on a number of things, particularly how and when paternity was determined.
