My soon to be ex is threating to take my daughter, he is making false claims that I am an unfit mother, i am not, and that I am mentally unstable, which I am not. he is very manipulative and not a nice guy. is he blowing smoke or does he have grounds. he is making me very afraid. He is an alcoholic and very verbally abusive. he is claiming that he will be the one to make me leave. if he takes me away from our daughter, this will destroy her. again, he is very manipulative. i have been marreid to him for 25 years and i am at my wits end, we are at our wits end. my daughter has 2 years of High school left and he needs to get out of our house. can i do so? I will need to place a restraining order on him. he claims he is not doing anything wrong. help!!

No one can tell you if he has a valid basis without knowing what his claims might be or the background on the case. Generally, initial custody determinations are made based on what is in the best interests of the child. The result often depends on how well you present your case with regard to the factors that a court considers. To do so effectively, it would be wise to hire counsel.
If you are going through a divorce, you can file a Motion for a temporary hearing. At that hearing the court can restrict the communication that occurs between the parties and decide who will reside in the house while the case is pending.
