Hello. The sort of situation you describe occurs occasionally, and a broad variety of circumstances can create the need for a change or transfer of custody. Sometimes there are health issues of the present caretakers; sometimes the child (who may be young, or a teenager) may be presenting behavioral or psychological or other health issues that indicate another custodian would be better-suited to caring for the child. A parent may have made a geographical move that affects what is best for the child. A teen may be having upsetting issues with the present caretaker, or with the school, or with the living situation generally; a teen may be facing chemical dependency/drug use issues. The present custodian of the child may be feeling overwhelmed by the needs and issues of the child. Sometimes it is just 'not a good fit' of caretaker with child. Every situation is unique to itself. With the situation you describe, I definitely recommend that you have an attorney assist you. I suggest to you that you should phone several Minnesota attorneys in choosing among attorneys, because you want to feel a sense of great trust with the attorney helping you. If I were phoned, I would discuss the situation, and the needs and wishes of you and the various family members, and the needs of the child. What is the child's best interest is always paramount in concern. There are ways to lessen legal costs while obtaining attorney counsel and help. I wish the best to you and your son, and the rest of the family.
