Legal Question in Family Law in Minnesota

Can someone videotape the inside of my home (from a window outside) without my knowledge or consent and use that videotape in custody court? I left my ex (my son's father) due to domestic abuse and I believe he is trying to gather evidence for his custody case. I live in Minnesota and currently have an order of protection against him.

A family court judge has discretion to allow or reject any evidence they feel is relevant to the case. As a result, the court may consider video tape evidence that you describe, but they are less likely to do so if a trespass has been committed to acquire the video. If the video was taken from outside of the home on the sidewalk or front door of the home, there is no trespass. thioose locatoins are open to the public
