Legal Question in Family Law in Minnesota

visitation

I have a daughter who does not want to go and see her Dad for visitation, at what age can she make this decision, she is currently 12 and we live in MN and she has to travel to MT for visitation. There have been many issues with counselors involved between Dad and daughter.

There is no magic age that Courts use to determine at what point the child's wishes will override other considerations in enforcing custody. Certainly, a 12 year old's wishes are considered as part of the Court's analysis of the best interests of your child. Moreover, Courts tend to give greater weight to the child's wishes as they grow older. However, there may be considerations in your case that would weigh more heavily in favor of continued visitation with your daughter's father.

In any event, you will need the Court to modify the current schedule if you want to relieve yourself of the obligations of the current custody order.
