Visitation Modification

I have sole physical custody and my ex and I have joint legal custody of my two children - during the divorce - we agreed to a 50/50 time split with the children. This has not worked well and it was decided that the children should be with me full-time with him having them everyother weekend. Can we modify visiation ourselves or do we have to proceed through the court system to have this done?? And how is child support modified and can we do this at the same time?

Thank you for your question.

If you have an agreement, the order may be modified with each party executinga Stipulation and Order that is sent to the Court to modify both custody and child support at the same time. There are no forms for this and it would require a lawyer. No hearing would be necessary.
